Please take the time to read this entire agreement (“agreement”) governing your responsibilities (hereinafter, “you”, “your” or “user”) and use of the handy bikes dc site (“site”). Failure To adhere to your responsibilities under this agreement may expose you to liability. (collectively with site, “handy bikes dc”, “us” or “we”).

I stand behind all labor performed for a period of thirty (30) days from date of dropoff as displayed on your receipt. HOWEVER I make no guarantee or warranty on any parts utilized during the course of any repairs, regardless of whether those parts were provided by you or by handy bikes dc or one of its suppliers; rather, parts warranty is covered by the manufacturer of the part. Flat tire repair shall carry a 24 hour guarantee, unless it is found that a new and separate flat tire has in fact occurred during that 24 hours, or if gross incompetence can be shown on the part of handy bikes dc or its employees during original repair; in either case labor shall be free, but the customer will be charged for the new tube.

In consideration of your use of the site and hiring of us to perform work for you, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the united states or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the site’s contact form and as requested for use on your written receipt (“contact data”), and (b) maintain and promptly update the contact data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or handy bikes dc has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, handy bikes dc has the right to suspend or terminate your account, return your bicycle and/or parts, and refuse any and all current or future services.

By using this site and/or hiring us to perform work for you, you agree to indemnify, defend and hold harmless handy bikes dc, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the site or services, any user postings made by you, your violation of any terms of this agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Handy Bikes dc reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with handy bikes dc in asserting any available defenses.

To the maximum extent permitted by applicable law, in no event shall handy bikes dc and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of this site or repair services, with the delay or inability to use the site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the site, or otherwise arising out of the use of the site, whether based on contract, tort, negligence, strict liability or otherwise, even if handy bikes dc or any of its suppliers has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the site, the services provided by handy bikes dc, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the site and the services provided by handy bikes.
